Court Acquits Kamikamica, after upholding No Case to Answer Application

The Suva Magistrates Court has dismissed the case against former Deputy Prime Minister Manoa Kamikamica, who was charged by the Fiji Independent Commission Against Corruption (FICAC) with 1 Count of Perjury and 1 Count of False Information to a Public Servant.
Resident Magistrate Charles Ratakele delivered his ruling this afternoon.
In his ruling, RM Ratakele considered the evidence of Counsel Assisting the Commission of Inquiry, Ms Janet Mason and Member of Parliament Mr Kalaveti Ravu, as well as the Agreed Facts and Documents.
The Court found there was no evidence that Mr Kamikamica made a false statement during the Commission of Inquiry proceedings.
It also ruled that Mr Ravu's diary entries, admitted under a hearsay exception, could only prove that the entries were made and not the truth of their contents.
The Court further noted that Mr Ravu did not explain or elaborate on the diary entries in his oral evidence or provide evidence that the accused's sworn statements were false.
In relation to the charge of False Information to a Public Servant, the Court found there was no evidence proving the information provided by the accused was false.
The Court also noted Ms Mason's evidence that the issue of the accused's alleged prior knowledge of the FICAC Commissioner's appointment fell outside the Commission of Inquiry's terms of reference and was not investigated.
The Court upheld the No Case to Answer application on both charges, dismissed the case, and acquitted Mr Kamikamica.
FICAC will review the Court’s written ruling before determining whether any further legal step is warranted within the statutory timeframe of 28 days.
Mr Kamikamica was represented by Mr Wylie Clarke while the FICAC State Counsels Ms Josann Pene and Mr Setefano Komaibaba appeared for the prosecution.
