The Suva High Court has set the trial date in the Kalivati Bakani and Keni Dakuidreketi case for seven weeks commencing 16th June 2014. The dates were confirmed after much deliberation between counsels and keeping in mind the availability of overseas counsel which the prosecution and the 2nd Accused have engaged.
FICAC Prosecutor informed Court that following the courts direction on the previous date, the prosecution have filed and served the revised list of documents and revised list of witnesses that they are minded to rely on and call upon at trial. Ms. Matakitoga mentioned that the list of witnesses can be further curtailed subject to certain documents being agreed upon.
Dakuidreketi's Legal Counsel, Wylie Clarke confirmed receipt of the prosecution's revised list of documents and witnesses. However, he identified certain irregularities in the statements of certain witnesses and in the documents disclosed which he wished FICAC to rectify. Ms Matakitoga in reply stated that FICAC is willing to rectify the irregularities and requested the Defence state the same in the form of a letter.
Counsel for Bakani, Mr. Vosarogo informed Judge Bandara that FICAC had also served them with a list of all undisclosed documents related to this case and which are kept at FICAC registry. He stated that when necessary, they would like to pay the FICAC registry a visit and that FICAC be on notice.
Following the confirmation of the trial dates, Ms Matakitoga informed Court that the prosecution is also in the process of drafting out a list of facts that could be agreed upon by all parties.
Justice Bandara has set the trial from 16th June to 31st July 2014 for 7 weeks. The Court informed Counsels to have further discussions and come to an agreement of any pre-trial matters.
The case is adjourned to the 29 of November for mention to check on Agreed Facts. |
