The FICAC case against Vimal Krishna was called before the Suva High Court this morning.
Mr. Vinsent Perera who appeared for FICAC, informed Justice Salesi Temo that after giving due consideration to the representations made by the Defence Counsel, FICAC had decided to discontinue the proceedings against Vimal Krishna. He then tendered the relevant document containing the intention of the Deputy Commissioner of FICAC to enter a Nolle Prosequi in open Court.
Mr. Devanesh Sharma who appeared for Mr. Krishna made submissions for the Court to make ancillary orders to deal with the discharge of his client in view of proceedings being discontinued.
He then thanked the prosecution for considering their representation.
Justice Temo whilst discharging the accused Vimal Krishna, also voiced similar sentiments saying that it was very professional for the prosecution to have considered the representations made by the defense even though the prosecution had the ultimate right and duty to charge or not to charge.
