Former Nadi Town Council Officers Found Guilty

Two (2) former senior public servants of Nadi Town Council were convicted by the Lautoka High Court Judge Justice Paul Madigan yesterday for Abuse of Office after he adopted the majority opinions of the Assessors.

Mr. Aisea Tuidraki, former Special Administrator and Mr. Sakaraia Serau, a former Acting Chief Executive Officer, were jointly charged with one (1) count of Abuse of Office contrary to section 111 of the Penal Code by the Fiji Independent Commission Against Corruption (FICAC) in 2014.

It was found that the duo wrote off the rates and interest that was to be paid to the Council amounting to $86,792.94 without the approval of the Minister for Local Government. The court stated that the power to write-off the aforementioned only vests with the Minister and in this case no such approval was obtained.

Justice Madigan agreed with the majority verdict and ruled that prosecution had proven its case beyond reasonable doubt and convicted the two Accused for Abuse of Office.

The two Accused are remanded in custody. The matter was adjourned to 4 December 2018 for mitigation and sentencing submissions.
