Case Against the Mayor & Accountant for Nasinu Town Council

Investigation into an allegation that the Mayor for Nasinu Town Council colluded with his Accountant to raise a cheque amounting to $2,344.42 for payment to Post Fiji Limited. The cheque was cashed at the Westpac Bank, Nabua, without the knowledge of Post Fiji Ltd.

The Officers were jointly charged for Abuse of Office and Embezzlement and appeared before the Nasinu Magistrates Court on 12 December 2008.

The trial of the Rajeshwar Kumar and Jaswant Kumar began on 1st February 2010 and upon the closure of the prosecutions case on 5th February 2010, the defence filed a No case to Answer application on 8th February 2010.

On 11th February 2010, Justice Daniel Goundar ruled that not enough evidence was shown by the prosecution to prove that the Mayor was guilty of the crime, however he ruled that there was a case to answer for Jaswant Kumar.

On 2nd March 2010, the former Town Clerk was sentenced to 12 months imprisonment. He has filed for an appeal after the trial. The appeal was heard in November 2011.
